Terms of service

By booking an Elle TENS hire, you agree to the following Terms and Conditions:

 

Ownership

The Elle TENS unit remains the property of Divine Birth at all times.

 

Cancellation & Refund Policy

Refunds for non-faulty Elle TENS units will not be provided once the unit has been dispatched.

The orders that have not been dispatched can still be canceled. The hire fee will be refunded less a $15 administration fee.

Non-use of a hired Elle TENS unit is at the customer's discretion, and no refund is available.

 

Condition of Equipment

Elle TENS unit, two wires, four sticky electrodes and spare batteries will be provided for every hire. 

Elle TENS units are sterilised and tested between hires. Divine Birth’s liability shall not exceed the hire charge.

Elle TENS unit is supplied in a full working order.

 

Customers Responsibility

Customer’s responsibility includes inspecting the Elle TENS machine and its associated hire accessories to ensure that the Elle TENS unit is functional and all the essential accessories are included. Any issues must be reported to Divine Birth immediately. Divine Birth accepts no responsibility where the customer fails to do so and thus disables Divine Birth from providing a timely resolution of the matter.

 

Receipt of Equipment

Where possible, Divine Birth aims to deliver the Elle TENS on or before the hire period starts. 

It may not be feasible to deliver the Elle TENS on or before the hire period start for urgent orders. In this case, Divine Birth will ship out the order on the same or next business day. The customer is encouraged to purchase express shipping for priority orders.

 

Return of Equipment

The customer agrees to return the Elle TENS unit to Divine Birth in the same condition it was received. The customer must return the Elle TENS machine and two wires.

The customer is responsible for the return of the Elle TENS machine to Divine Birth. The customer is supplied with a pre-addressed pre-paid satchel to achieve this.  The customer agrees to follow all return instructions.

Responsibility for the Elle TENS unit transfers to the customer once delivery is confirmed and remains with the customer while the unit is in their possession and during return transit, until it is received by Divine Birth.

The unit must be returned by the last day of the hire period unless otherwise agreed with Divine Birth.

If the unit is not returned within two weeks of the due date and no extension has been purchased, the customer will be charged the full retail replacement value. Once this payment is made, the Elle TENS will become the property of the customer.

 

Loss, Damage & Non-Return Policy

Divine Birth reserves the right to charge the replacement value for any lost, stolen, or damaged TENS units or parts.

If the unit is not returned by the due date, a late fee of $10 per week will apply.

If the unit is more than 14 days overdue, it may be deemed lost, and the full replacement cost will be charged.

The replacement costs are:

Elle TENS 2 – AUD $230

Elle TENS Plus – AUD $259

Wires – AUD $25 per wire, or AUD $50 for both wires

In addition to the replacement cost, late return fees of $10 per week will be charged for each week the unit remains unreturned past the original due date. These late fees will apply on top of the replacement charges.

If the item is returned after the replacement cost has been charged, Divine Birth may offer a partial refund at its discretion, depending on the condition of the item and timing of the return.

 

Hire Extensions

Hire extensions can be accommodated at an extra cost and can be purchased from the Divine Birth shop.

 

No Guarantee

The success of Elle TENS is neither guaranteed nor implied.

 

Usage Instructions

The Elle TENS unit must be used according to the instructions provided. Divine Birth is not liable for any injury or damage resulting from misuse.

 

Contraindications

Do NOT use TENS before 37 weeks of pregnancy unless under medical supervision.

Electrodes should only be positioned as recommended for childbirth.

Do NOT place electrodes on the abdomen (before birth), the front or side of the neck, or areas on the head, which could cause current to flow transcerebrally.

Do NOT immerse the Elle TENS in any liquid. Ensure that your skin is fully dry before placing the electrode pads.

Do NOT use TENS if you have a demand-type cardiac pacemaker.
